3. Counter-Notification

If you believe someone mistakenly removed or disabled your content due to a DMCA notice, you may submit a counter-notification. This must include:

  • Your physical or electronic signature;
  • Identify the content that someone removed or disabled, and specify its location before removal.
  • A statement under penalty of perjury that you believe the content was removed by mistake or misidentification;
  • Your name, address, telephone number, and email;
  • A statement that you consent to the jurisdiction of the federal court in your district. Additionally, you must state that you will accept service of process from the party who submitted the original DMCA complaint.

4. Repeat Infringers

By the DMCA and other applicable law, Wavy Shrimp has a policy of terminating, in appropriate circumstances, users or account holders who are deemed to be repeat infringers.
